02 The most misquoted number in trucking

Quick answer

Almost every claim that a particular percentage of truck crashes is caused by driver error traces to one federal study. That study's own report to Congress states that the variables those percentages come from should not be treated as the cause of a crash.

This matters for a practical reason. Figures presented as cause findings get quoted in demand letters and repeated on hundreds of websites, and the moment somebody checks the source the argument weakens rather than strengthens.

The report explains its method: the coding of the events surrounding the crash begins with the "critical event," the "critical reason" for the critical event, and "associated factors" for the crash. None of these variables in and of themselves should be considered the cause of the crash, but when analyzed properly, can lead to a better understanding of crash causation and guide countermeasure development. It also states plainly that crashes are the probabilistic result of a range of factors. On scale, the study examined 967 crashes involving at least one large truck, weighted to produce national estimates for the estimated 141,000 large trucks involved in fatal and injury crashes during the 33 month study period, and collected almost 1,000 data elements. There is an awkward footnote to this, and we would rather set it out than tidy it away. The agency's own press release announcing the study was headed with the statement that driver behavior causes most truck crashes. So the framing the report cautions against appears in the publisher's own publicity. Both are the agency's words. Anyone quoting a percentage from this study should know that the report and the press release do not say the same thing, and should be ready for the other side to point that out.

03 Where the federal numbers come from

Quick answer

Four families of public source do most of the work: a census of fatal crashes, an annual compilation of large truck and bus crash facts, a database of carrier inspections and violations, and periodic causation research.

Knowing which one a figure came from usually tells you what it can support, and most published truck accident statistics come from just two of them.

  • The fatal crash census. Operated by the highway safety agency, it aims to record every fatal crash on public roads. This is the most reliable truck accident data available and it is why death counts are stated confidently.
  • The annual crash facts compilation. The motor carrier agency publishes a yearly volume drawing together crash, injury and exposure figures for large trucks and buses. It is the usual origin of headline national numbers.
  • Carrier inspection and violation records. Roadside inspections, violations and out-of-service results are recorded against individual operators and can be searched by company. This is the only source on the list that speaks to one defendant.
  • Causation research. Occasional, expensive, sample-based studies of why crashes happen, of which the study quoted above is the best known. Rich, dated, and easy to misread.

Injury figures are worth a separate word. Deaths are counted; injuries are largely estimated from samples of police reports, and the definitions of what counts as an injury are not uniform. Any set of truck accident statistics that presents injury totals to the same precision as death totals is overstating what the underlying data supports.

04 What the data cannot tell you

Quick answer

It cannot tell you who was legally at fault in any crash, what a case is worth, or what happened in yours. National datasets describe populations. Liability is decided on particular facts, and no percentage substitutes for them.

This is the limitation that matters most to somebody reading these pages after a crash.

  • Fault is a legal conclusion. Crash datasets record circumstances, not findings of liability, and the two are decided by different processes.
  • Settlement values are not in any federal dataset. Anybody publishing an average settlement is not drawing it from public crash data.
  • Under-reporting is real. Crash counts depend on police reports being made and coded, and less severe collisions are least reliably captured.
  • Lag is unavoidable. National figures are published well after the year they describe, so the most recent complete year is never the current one.

One historical figure is worth quoting for scale, expressly as history rather than as the present position. A 2009 report to Congress recorded that in each year of the preceding decade over 4,800 people have been killed and over 100,000 people injured in crashes involving large trucks. That is a statement about the late 1990s and 2000s. It is not a current count, and we have not used it as one.

07 How to check a figure before you use it

Find the publication, find the year, find out what was actually measured, and check whether the wording has drifted between the source and the page quoting it. Most dubious figures fail at the first step.

Not which website. A real figure has a report behind it with a title and a publisher. If the trail ends at another blog, stop there.

Which is not the year of publication and often not the year of the page quoting it. National figures lag the period they cover.

Crashes or vehicles involved. Deaths or casualties. Trucks over a weight threshold or all trucks. These distinctions change numbers substantially.

Compare the wording to the source

Watch for a study's cautious phrase becoming a confident one. A critical reason turning into a cause is the commonest example in this field.

A national percentage is not evidence about your crash. It may frame a conversation; it will not establish what happened to you.

Quick answer

Government publications and primary law only, quoted rather than characterized, with the publication and year attached. Where we have no source we had read, we publish no number and say so.

The standard exists because this field is full of figures that have been copied so many times their origin is untraceable.

  • We quote, and we link. If a source says something useful, its words appear here rather than our summary of them.
  • We date every figure. Because a number without a year is a number that will be wrong eventually and quoted anyway.
  • We name what we did not check. Where we have not read a provision or verified a status, the page says so rather than implying completeness.

The first is so common that it has become the ordinary way this field talks, which does not make it right.

How to spot a figure that will not survive scrutiny

Caused by. Where the underlying study coded a critical reason and disclaimed cause, a page asserting cause has changed the finding. Average settlement. No federal crash dataset records settlements, so any average has come from somewhere unstated. No year. A national figure without the year it describes cannot be checked and will eventually be wrong. Circular citation. If the link goes to another law firm's page, which links to another, the number has no origin. Precision without a basis. Injury counts quoted to the nearest person suggest a census where there was a sample.

A closing note on the purpose of all this. The federal data described here is national, but almost everything that decides a claim is state law: what may be recovered, how responsibility is divided where more than one party contributed, whether any cap applies, and the deadline for bringing a claim. Why this page carries no current national totals. Figures go out of date and then get quoted anyway. Earlier in the building of this site we published a figure that had been superseded four weeks before the page went live, which is the kind of error that is easy to make and hard to notice. National counts therefore live on the child pages listed above, where they can be updated as each agency publishes, and this page confines itself to explaining what those numbers are and are not.

On the tension in the causation study. We have quoted both the report's caution and the press release that ignores it. That is not an attempt to score a point against the agency: the study is careful, extensive and genuinely useful, and the caution is exactly the kind of thing a serious researcher writes. The problem is downstream, in the thousands of pages that quote the percentages without the caveat. Anyone using a figure from that study in a real dispute should read the methodology first.

What is not here. We have not summarized the four data families in numeric detail, because that belongs on the pages that carry the numbers. We have published no settlement averages, because no public crash dataset contains settlement values. Only as context, and with care. National data describes populations, not individual crashes, and no percentage establishes what happened to you or who is liable for it. What actually decides a case is the specific evidence: records, inspections, data from the vehicles, witnesses. A statistic can frame a conversation with an insurer. It will not carry the argument, and a misquoted one can undermine it.

Where can I look up a specific trucking company?

Federal carrier records are public and searchable by company, and they include roadside inspection results, violations and out-of-service outcomes. That is genuinely useful because it is specific rather than national: it speaks to the operator involved in your crash. Why do published figures always seem a few years old?

Because national datasets are compiled from state and local reports, coded, checked and then published, which takes time. The most recent complete year available is therefore never the current year. That lag is normal and not a defect, but it does mean a page claiming to give this year's national totals is either estimating or wrong, and either way it should say which.

Is there an average settlement figure for truck accident cases?

Not one drawn from public data, because no federal crash dataset records settlements at all. Figures presented as averages have come from somewhere unstated, often a firm's own past results, which are not a representative sample of anything. Serious injury claims also vary so widely that an average would mislead even if it were sound. We publish no settlement averages anywhere on this site.

Do I have to pay anything up front?
